ORDER
This matter came on to be heard on May 14, 1979, on the
: Petition for Equitable Distribution filed herein by the
Plaintiff, THEODORE GILCHRIST, in connection with a Workmen's
Compensation lien filed in this cause by AMERICAN HOME ASSURANCE
COMPANY, and the Court heard the argwment of counsel and being
fully advised in the premises, it is therefore,
ORDERED AND ADJUDGED that:
1. The parties stipulated and the Court finds that
the compensation carrier, AMERICAN HOME ASSURANCE COMPANY, has
paid to date $8,687.00, in monetary compensation benefits for
lost wages and $4,135.69, in medical compensation benefits for
! a total amount of $12,822.69. The Plaintiff, THEODORE GILCHRIST,

i is a 41 year old mechanic, with an average weekly wage at the
~ time of his industrial accident of $225.00 per week.

~ 2. The Plaintiff, THEODORE GILCHRIST, with no object-
~
~
~ ion presented testi.mony and evidence from THEODORE HERZOG,
~ ESQUIRE, a duly qualified expert Attorney at Law, and who was
the attorney for the Defendants, JAMES HARRY and MARY HOWARD
~ HARRY, and their insurance carrier, in this lawsuit; ATTORNEY
~ THEODORE HERZOG testified that the Plaintiff's case had a value
~ of between $50,000.00 and $70,000.00. The policy of liability
insurance issued by SOUTH CAROLINA INSURANCE COMPANY, to the
~ Defendants, JAMES HARRY and MARY HOWARD HARRY, was in the amount -

~ of $15,000.00.
