This matter coming before the Court on Plaintiff's
Motion to Compel Discovery, the Court finds as follows:
1. The Deposition of Defendant, SPIRIT OF AMERICA, INC.,
was properly set for 27 April 1979 at 9:00 a.m. Defendant, SPIRIT
OF AMERICA, INC., failed to appear.
2. Defendant, SPIRIT OF AMERICA, INC., has failed to
respond to Plaintiff's Notice to Produce filed with the Court on
6 March 1979..
WHEREFORE, IT IS I~REBY ORDERED:
1. Defendant, SPIRIT OF AMERICA, INC., shall appear at
Deposition by one or more persons designated to answer the questions
' enumerated in the Notice of Taking Deposition filed in this ase on

i 5 March 1979. This Deposition shall take place on the day of
~ , 1979, at 32 East Ocean Boulevard, Stuart, Florida, at
