OF
AMENDMENTS TO DECLARATION OF CONDOMINIUM
The undersigned, being the hereinafter designated
officers of GULF OIL REAL ESTATE DEVELOPMENT COMPANY, the General
Partner of HUTCHINSON ISLAND LIMITED PARTNERSHIP, a Florida
limited partnership and the Developer of BEACHTREE I CLUSTER, A
CONDOMINIUM, and the duly elected President and Secretary of
BEACHTREE I CLUSTER, INCORPORATED, do hereby certify that the
following were duly enacted as amendments to the Declaration of
Condominium of BEACHTREE I CLUSTER, A CONDOMINIUM, by said Developer
and by BEACHTREE I CLUSTER, INCORPORATED at a duly called meeting
of the members of the Corporation held on the ~ day of
1979. The original Declaration of Condominium of
said Co ominium was recorded in Official Record Book 296, page
1438 et seq., Public Records of St. Lucie County, Florida.
1. Article III F of the Declaration of Condominium is
amended to read as follows:
F. The easements set forth in Article
III A, B, C, D, and E, supra, shall run with
the Land and shall be binding upon every Unit
Owner and every claimant of the Condominium
Property or any portion thereof, or of any
interest therein, and their respective heirs,
executors, administrators, successors and
assigns. Should the intended creation of any
easement fail by reason of the fact that at
the time of creation, there may be no grantee
in being having the capacity to take and hold
~ such easement, then any such grant of easement
deemed not to be so created shall nevertheless
be considered as having been granted directly
~ to the Association for the purpose of allowing
the original party or parties to whom the ease-
meats were originally granted the benefit of
p such easement and the Unit Owners designate the
Developer and/or Association as their lawful
attorney in fact to execute any instrument on
their behalf as may hereafter be required or
deemed necessary for the purpose of creating
such easement.
