II~~1NQ:R, who, being first duly sworn, says as follows: 1. Affiant's name is CARL F. II~NC£R, his prof..ssion is :lttnrney at Law, and his plave of business i.s 51 E. Ocean Boulevard, Stuart, Florida 33494. 2. He was attorney for OLogistics, Inc., a Florida corporation, on and about May 26, 1978 when he prepared that certain Claim of Lien by the said Ologistics, Inc. against Hutchinson Island Limited Partnership, dated May 26, 1978 and recorded on May 30, 1978 in Official Records Book 287, pages 2582 and 2583, of the public records of St. Lucie county, Florida, in the amount of $233,068.00, effecting property more par- ticularly described in said Claim of Lien and as described in Exhibit "A" attached hereto and made a part hereof. 3. Affiant believes that, on May 19, 1978, the said Ologistics, Inc. filed a Petition t~der Chapter ll, Unit,ed States Code (earkn~tcy Act) . ' 4. Affiant further believes that Section ll of Chapter 11, United Stated Code (Ban}crvptcy Act) provides as follows: "e. A receiver or trustee may, within two years subsequent too the date of adjudication or within such further period of time as the Federal or State law may permit, institute pYnoeedings on behalf of the j estate upon any claim against which the period of limitation fixed by Federal or State law has not expired at the time of the filing of the Petition ~ in banknaptcy." i ~ 5. Accordingly, Affiant believes that the period for enforoetnent, by suit or otherwise, of the Claire of Lien dPSCribc~ in ?'aragraph 2. k above has been extended by virtue of the provisions of Section ll of the ~ Bankniptrcy Act aforesaid, and accordingly will rot expire, by virtue thereof until May 17, 1980.
