with the purposes authorized in the Articles of Incorporation,
By-Laws and under this Declaration, and in no event shall any !
suit for partition or accounting be had of or for the funds,
assets or property of the Association.
Section 6. Assessments. In order that the Association
may provide for and pay the cost of carrying out its said
duties and powers in order to fulfill the said purpose for
which it is established, the Association shall have the right
and authority to make, levy, and collect assessments to pay
its cost and expenses against members of the Association as
owners and their respective parcels. The said levy, assessment
and collection thereof to be operative and binding upon all of
the owners of the parcels as follows:
' A. Both regular and special assessments must be fixed
in a uniform manner and rate for owners for all parcels.
However, assessments resulting from failure of an owner to
comply with the terms of this Declaration or which is attributable
to the willful or negligent act of an owner of a parcel, his
family, guests, lessees or invitees, which necessitate the
Association to expend money to maintain, repair, or restore a
parcel of portion thereof, shall only attach to such owner's

parcel or parcels or the parcel or parcels for which the money

~ was expended.
B. Purpose of Assessments. The assessments levied by
€i the Association shall be used exclusively to promote the
health, safety and welfare of the owners and for the improve-
ment and maintenance of the easement areas and of the parcels

and dwelling units. Assessments shall be used for, and the
! Association shall acquire and pay for out of the funds derived
from assessments, the following:
1. Maintenance and repair of the aforesaid parking
easement and ingress/egress easement areas.
I 2. Maintenance of lawns, landscaping, plants and
