HomeMy WebLinkAbout2043 z' consist of at least one member of the Association and shall serve in accordance with such rules and regulations as may be established by the Association, but subject to the limita- tions set forth as to alterations, repairs, additions and improvements of parcels and dwelling units as contained in this Declaration, the Articles of Incorporation and By-Laws of the Association. ARTICLE IX GENERAL PROVISIONS Section 1: Enforcement. Declarant, the Association or any owner shall have the right to enforce by any proceeding at law or in equity, all declarations, restrictions, conditions, covenants, easement, party walls, reservations, liens and charges now or hereafter imposed by the provisions of this Declaration. Failure by Declarant, the Association or any owner to enforce any such Declaration restriction, condition, covenant, easement, party wall, reservation, lien, and charges herein contained shall in no event be deemed a waiver of such right to do so thereafter. In the event it becomes necessary ~ to enforce this Declaration by any proceeding at law or in I equity, the Declarant, Association or any owner bringing such enforcement action, if successful, shall be entitled to recover the cost of the proceeding and such reasonable attorney's fee as may be determined by the Court. I ~ Section 2. Severability. Invalidation of any one of 1 ~ the covenants or restrictions by judgment or court order shall ~ in no way affect any other provision which shall remain in a full force and effect. t Section 3. Amendments. A.
