That LUCILLE E. JORDAN died testate on or about October 14, 1976, domiciled in St. Lucie County, Florida. 2. That the Last Will and Testament of decedent, dated° 1~1ay 15, 1970, and codicil thereto dated December 29, 1971, were duly admitted to probate and record in these proceedings. 3. That as may be seen from the proba[e file herein, the administration of said estate has been completed, all debts and 'i claims paid, and closing letter obtained from the Internal Revenue: 4 Service. ~ ; 4. That all assets of said estate have been distributed ~ E ~ save and except certain assets in the hands of the Northern Trust ~ Company of Chicago, Illinois, remaining in its hands as left over : ~ from the Walter J. Carrick Trust of which said bank was trustee. S. That in Item IV paragraph (c) of the will of the' ~ decedent, it Was provided: ~ "(c) I give and bequeath to MELISSA LYNN McKEY, (herein- ~ ~ ~ after called "MELISSA") and STEVEN PATRICK CARRICK McKEY (herein- ~ ~ ~ after called "STEVEN"), the sum of Forty Thousand Dollars ; v~ ($40,000.00), in equal shares, if +they both shall be living at the ~ ~ ~ time of my death." x ~ and in Item VI paragraph 4 as follows: ~ ~ "4.
