~ 6. That in and by paragraph 4(h) of the-codicil of the ;
~will of decedent, it is provided as follows:
"4.(h) All of the rest, residue and remainder, if any

~ there be of said trust fund designated and referred to in said

' Last Will and Testament of WALTER J. CARRICK, deceased, as the ~
"'Marital Trust', I give, bequeath and devise to WILLIAM, RAMSAY,

~RICHARD, MELISSA and STEVEN, equally, share and share alike;. ~

7. Thut your Petitioners were both under the age of ;
twenty-one (21) years at the time of decedent's death and remain
: so at this time.
8. That First Bank and Trust Company of Boca Raton,
named in said codicil as Trustee, has renounced its,right to act
~ as_such, a-copy of which is filed with this Petition, and it is
necessary that a successor trustee be appointed to administer said
trust under the will until such time as Petitioners become twenty-
one (21) years of age. ~ ~
9. That Eugene W. Murphy, Jr., a practicing attorney
and member of the Florida Bar, with offices at Royal Trust Bank
' Building, 411 South County Road, in the Town of Palm Beach, Florida,
and a resident of Palm Beach County, Florida, has agreed to act as

trustse.

j WIIEREFORE, Petitioners request that said Eugene W. Murphy,
i
~ Jr., be appointed as Trustee herein of the assets remaining in the
' - possession of the Northern Trust Company for their benefit and thaC ;
i

~ he be ordered and directed to administer said trust in accordance
~
# with the Last Will and Testament of the decedent.
