AGREED ORDER TAXING FEES AND COSTS
THIS CAUSE having been voluntarily dismissed by the
Plaintiff under Florida Rule of Civil Procedure 1.420 and
this matter having come on before the Court upon the joint
motion of the parties to tax fees and costs and the Court
being fully advised in the premises, it is thereupon;

~ ORDERED and ADJUDGED that the firm of Kelly, Black, Black,
~ Wright & Earle shall be awarded an attorney's fees of $500 in
~ this cause, and is hereby awarded the sum of $1,585 for costs.

~ Additionally, Larry Condict is awarded a$900 fee for appraisal
services. ~
The Clerk of this Court shall accordingly issue a check to -
Kelly, Black, Black, Wright & Earle P.A., 1400 Alfred I. DuPont
~ Building, Miami, Florida 33131, in the total amount of $2,085,
~ and shall issue a check in the amount of $900 payable to
~
~ Larry Condict. The Clerk shall mail the checks to Kelly, Black,
~
Black, Wright & Earle, P.A., 1400 Alfred I. DuPont Building,
~ Miami, Florida 33131. In the event the sums in the registry ~
~
~ of the court are not sufficient to enable the Clerk--to wrrte
~ -
~ the aforesaid checks, the Plaintiff, I~epartment of Transportation,
~ ~
~ shall forthwith deposit in the registry of the court $2,985, ;
