HomeMy WebLinkAbout1615 44'7626 I.S~ MORTGAGB AGREffi~NT This agreement made this / day of 197 between William C. Furst, Jr. and Darla Ann Furst, his wife, and illiam C. Furst and-Joan H. Furst, his wife, hereinafter called the Mortgagors and Chelsea Title ~ Guaranty Company, hereinafter called the.Mortgagee reflects the agreement of the parties that the Mortgagors presently owe the amount of $308.95 to the Mortgagee for monies paid on their behalf on a purchase money mortgage from the Mortgagors to Robert G. and Mary W. Hall, recorded in 0. R. Book 276, page 2552, St. Lucie County, Florida records, and further that the parties have agreed that the Mortgagor will continue to make periodic quarterly payments beginning on 1 September 1978 to the said Robert G. and Mary W. Hall for the benefit of the Mortgagors. Therefore it is agreed by the Mortgagors that the advances made by the Mortgagee shall be included herein as the principal debt and that interest will accrue to the benefit of the Mortgagees at the rate of Six per annum on the principal as it exists from time to time. ~ Witnesseth, that is consideration of the sum named herein and in the promissory note of even date herewith, the Mortgagors hereby grant, bargain, sell, alien, re- mise, convey and confirm unto the mortgagee, its heirs and assigns, forever, the following described land, situate, lying and being in the county of St. Lucie, State of Florida, to-wit: Lot 6 and the North 18 feet of Lot 7, Block 9, OCEANVIEW SUBDIVISION, according to the plat thereof as recorded in Plat Book 6, page 61 of the Public Records of St. Lucie County, Florida, and the said Mortgagors do hereby fully warrant the title to said land, and will defend the same against the lawful claims of~all persons whomsoever. Provided always, that if said Mortgagors, their heirs, legal representatives or assigns, shall pay unto the said Mortgagee, ~ legal representatives or assigns, a certain promissory note dated the 1st day of une ~ A. D. 1979, for the sum of ` $1,337.20, which includes interest at SAX on the balance-due as advances are made by the Mortgagee under the periodic schedule and perform, comply with and abide by each and every the stipulations, agreements, conditions and covenants of said pro- missory note and of this mortgage, and shall duly pay all taxes, and also insurance premiums reasonably required and all costs and expenses including a reasonable attorney's fee, which said Mortgagee may incur in collecting money secured by this mortgage, and also in enforcing this mortgage by~suit or othereise, then this wort- ' gage and the estate hereby created shall cease and be null and void, s IN WITNESS WHEREOF, the said Mortgagors hereunto set their hands and seals the day and year first above written.
