THIS CAUSE having come on for hearing on the Defendant's
Motion for Judgment on the Pleadings and the Plaintiff's Motion to
t
Strike an Affirmative Defense and the Court having heard argument
of Counsel, reviewed the pleadings and papers filed herein and being
otherwise fully and well advised in the premises, the Court finds as
follows: ~
1. The Complaint for Determination of Paternity and for
Child Support shows upon its face that the subject child was born on 3
August 28, 1968.
2. That the Defendant has been within the jurisdiction of
this Court during the period of time. since that date to the present.
3. That the Defendant has not contributed child support to
the subject child.
4. That this paternity action is barred by Section 95.11(3)
(b) (1977) F.S.
-5. That Section 95.11(3)(b). (1977) F.S. is constitutional ~
and does not violate Article I, Section 21 of the Florida Constitution.
NOW THEREFORE, it is
ORDERED AND ADJUDGED that the Plaintiff's Motion to Strike
the Defendant's Affirmative Defense pertaining to Statute of Limitations
shall be and it is hereb denied. It is further

ORDERED AND ADJUDGED that the Defendant's Motion for Judgment
on the Pleadings shall be and it is hereby granted and the Defendant, }
JEFF k'iLLIAMS, shall go hence without day.
DONE AND ORDERED at Fort Pierce, St. Lucie County, Florida,
