Judgment, and the Court having heard argumept of counsel, having reviewed the
pleadings, affidavits filed in support of Defendant's Motion, and the depo-
sitions of witnesses, and being otherwise 'advised in the premises, the Court
finds a genuine issue as to material facts in this matter, and therefore it ~
is
ORDERED AND ADJUDGED that Defendant's Motion for Summary Judgment
be and hereby is denied.
