PARTIAL RELEASE OF MORTGAGE
KNOW ALL MBN BY THESE PRESENTS, Whereas, Bay Colony of Stuart, Inc. ~
by indenture of Mortgage bearing date the 10th day of November A.D. E
1977, and recorded in the office of the Clerk of the Circuit Cour t
in and for the County of St. Lucie , State of Florida,
in O.R. Book 277 , Page ~3~y and modified by Modification Agree- _
meat between the parties, dated December 4, 1978 and recorded in
O.R. Book 299 Page 289 , granted and conveyed unto FIRST FEDERAL
SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE and assigns, the premises
therein particularly described, to secure the payment of the~sum of
SEVEN HUNDRED THOUSAND AND NO/100 DOLLARS ($700,000.00) with interest
as therein mentioned:
AND WHEREAS the said BAY COLONY OF STUART, INC. has requested the
said FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE to `
release the premises hereinafter described, being part of said.
mortgaged premises, from the lien and operation of said Mortgage:
NOW, THEREFORE, KNOW YE, That the said FIRST FEDERAL SAVINGS AND
LOAN ASSOCIATION OF FORT PIERCE, as well in consideration of the
premises as the sum of one dollar and other good and valuable con-
sideration dollars, to it iri hand paid by the said BAY COIANY OF
STUART, INC. at the time of the execution hereof, the receipt
whereof is hereby acknowledged, does remise, release, quit-claim,
exonerate and discharge from the lien and operation of said mortgage
unto the said BAY COLONY OF STUART, INC., their heirs and assigns, _
all that piece, parcel or tract of land, being a part of the premises
conveyed by said mortgage, to-wit:
Lot 23, BAY COLONY OF STUART, according to the plat
thereof on file in the office of the Clerk of the
Circuit Court, in and for St. Lucie County, Florida,
in Plat Book 19, Page 1.
TO HAVE AND TO HOLD the same, with appurtenances, unto the said BAY
COLONY OF STUART, INC. and assigns forever, freed, exonerated and
discharged of and from. the lien of said mortgage, and every part
thereof; Provided, always, nevertheless, that nothing therein con- ;
tained shall in anywise impair, alter or diminish the effect, lien
or incumbrance of the aforesaid Mortgage on the remaining part of
said mortgaged premises, not hereby released therefrom, or any of
the rights and remedies of the holder. thereof.
IN WITNESS WHEREOF, the said Mortgagee by its duly authorized
officers, has hereunto set its hand and seal this 13th day of June,
