DEVIT ADAMS, etc., et al., Defendants. ` O R D E R THIS.CAUSE coming on to be heard on Defendants', ! t DEVITT ADAMS and AMERICAN EMPLOYERS INSURANCE COMPANY, motion -for rehearing on Plaintiffs' motion for continuance, and the Court having con~iidered the same, upon due consideration, the motion for rehearing shall be treated the same as a motion for reconsideration of the Court's order of June 8, 1979 granting the motion for continuance. The Defendant's, RITECO,~attorney arranged for a telephone conference with the various attorneys t so that -the out of town attorneys would not have to be present at the hearing on the motion for continuance. The conference hearing was scheduled f.or 10:00 o'clock a.m. on June 8, 1979. Present at the hearing was one of the attorneys for-Plaintiffs. The telephone operator advised the Court that one or more of the attorneys for Defendants was unavailable at approximately i e 10:15 a.m., but that she-would keep trying to reach them. The Court waited approximately thirty minutes for the telephone conference call to be completed and then placed a call to ~ Riteco's attorney, at which time Plaintiff's attorney argued his motion for continuance and Riteco's attorney argued against the motion. Zt is regretable that the attorney for Adams and x ~ American Employers Insurance Company was not present at the a hearing and that the telephone operator was unable to contact -him, but the Court waited more than thirty. minutes before pro- R ceeding with the hearing.
