4. The Motion for Preremptory Writ of Mandamus filed
by Petitioner in this cause shall not be treated by this Court
as an appeal from the Order entered by Honorable E: P. DeFriest,
Judge in and for St. Lucie County, Florida, in Case No. 79-185 MM
dated May 3, 1979.
5. For the above and foregoing reasons Petitioner's
Motion for Preremptory Writ of Mandamus is Denied .and the
Court finds for the Defendant, C. L. Norvall as Sheriff of
St. Lucie County, Florida, in this cause and against the
Petitioner, .Paul DePoo. f~
