Grantee, by acceptance hereof, and by agreement with GranLor hereby _
expressly assumes and agrees to be bound by and to comply wlth all of the
covenants, terms, conditions and provisions set forth and contained in the '
aforedescribed Declaration of Condominium, including, but not limited to, the
~ obligation to make payment of assessments for the maintenance and operation
~ of the Condominium whfch may be levied against the above described Apart-
E ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
€ tion and Agreement for and Grant of Easements and Other Rights (the "Settle-
ment Stipulation") and a Declaration of Protective Covenants and Restrictions
' (the "Pr.otective Covenants"), as hereinafter set forth. The Settlement Stipu- 3
~ lation provides for this Condominium Lo be served by certain facilities of High
: Point of Fort Pierce Condominium Section 1 and the Protective Covenants ~
~ prnvides for certain land use covenants upon the land areas dzscribed therein
a (including, but not limited to, portions of the land areas included within this
Condominium) and provides for certain drainage easements and other ease-
~ ments and rights including, but not limited to, the "Roadway Easement",
~ -"Sewage System Rf ghts" ,"Water System Rights" and "Future Development
~ Property Drainage Easement", all as are more particularly described therein, i'
ti all in addition to the other matters set forth in the Settlement Stipulation and ~
~ Protective Covenants, which other matters include, but are not limited to, the ~
obligation to pay certain "Assessments" as are respectively set forth in the `
~ Settlement Stipulation and Protective CovenanLs. Grantee expressly acknowl- ;
~ edges and assumes the obligation to pay the amounts assessed against the
; Apartment under both the Settlement Stipulation and Protective Covenants and
~ ~ acknowledges that "Assessments" under both the Settlement Stipulation and
; Protective Covenants against all properties now or hereafter inciuded within
