HomeMy WebLinkAbout0509 - t . ` This Note is secured by a mortgage (the Mortysge), dated the dste he~eof, of property situated in the State of Florida, granted by the Maker to the Payee, to which reference is hereby made for a descriptfon of the mortgaged property, the nature and extent ot the security, the rights of the Payae in respect thereof and the terms arxi conditions upon which this Note is issued. f The Maker agrees that it shail be bound by any agreement extending ' the time or moditying the above terms of payment, made by the Psyee a~d ; the owner or owners of the property ~(fected by the Mortgage, whether with ~ or without notice to the Maker, and the Maker shall continue liable to pay the amount due hereunder, but with interest at a rate no greater tha~ the Interest Rate, according to the terms of any such agreement of extension or modification. ~ The unpaid balance of the Principal ~lmount, plus accrued interest shall become due and payable at the option ot the Payee under the happening of an event by which said batance shall or may lxcome due and p~ysble under the terms of the Mortgage. ~ ; This Note may not be changed orally, but only by an agreeme~t in ~ writing, signed by the p~rty against whom enforcement of any waiver, cF~ange, modification or dischsrge is saight. All parties to this Note, whether Maker, principai, surety, gusrantor - or endorser, hereby waive presentment for payment, demand, protest, j notice of protest, and notice ot dishonor, and expressly agree jointly and E severally to remain and continue bound tor the payment of Ehe principal a~d r ~ interest provided for by the terms of this Note, notwithstanding any exten- ~ sion or extensions of the time of, or tor the payment of said principal or E iMerest, or any change or changes ih the amount or amounls agreed to be - ~ paid u~der or by virtue ot the oblic~ation to pay provided for in this Note, E or any change or changes by v?ay of release or surrender or substitution ~ of any real property and collateral, or either, held as security for this ~ Note, and waive at! and every kind of notice of such extension or extensions, ~ change or changes, and agree that the same may be macle witFx~ut the joinder ~ of the Maker. ltye principal of this rnte may be pre~paid in wl~nle or in part with interest to date of payment without penalty.
