the Defendant's Motion to Discharge the Lis-Pendens filed herein
and Defendant's Motion to Dismiss the Complaint, and the Court
having heard argument of counsel, it is
ORDERED, CQNSIDERED AND ADJUDGED as follows:
1. That the Motion to Dismiss the Plaintiff's First
Ca~se of Action be and it is hereby denied and that the Defendant
shall file his Answer to same within ten (10) days from the date
hereofi .
2. That Defendant's Motion to Dismiss the Plaintiff's -
Second Cause of Action be and it is hereby granted with leave to
the Plaintiff to file an Amended Second Cause of Action within
~ ten (10) days from the date hereof.
