4. Covsxex~r Ac~xar L~xe.
' The Compai~y~ agrees that each Leased Parcel sha11 be sold and
convesed by the Company to Properties free and clear of all liens,
' - charges and encumlirancea (other than this Lease), ezcept as set forth
with respect to anch Leaaed Parcel in Appendiz A and eacept the fol-
lowing (hereafter, together with the ezceptiona contained in Appendiz
A, called ' `Permitted Liene") :
~ (a) liens for tazes, assessments, fees, water, sewer, or other
rents, rates and charges, ezcises, leviea, license feea, permit feea
and other authorization fees and other impositions referred to in
Parag?raph 9, provided tLst in each ease the same shall not be
delinqnent to the eztent that penalties for non-paym~nt thereof
may then be assessed or that such Leased Parcel, or any portion .
thereof, may then be suUject to forfeiture, or shall be the subject of
a contest as to their amount or validity in accordance with the pro-
i visions of Paragraph 9;

~ (b) minor defects, irregularities, encnmbrances, easements,
~ rights of ay, ~er~rit~ides, restrictions and cloud$ on title which do
~ not in the reasonable opinion of the Company materially impair
` the use of such Leased Parcel for the business purposea of the
~ Conipuny or Conti~ientul;
(c) easements for streets (which term as nsed herein shall
~ include ~withont limitation roads, highways, enrbs and gatters,
~ drains, conduits, snbways, ramps, viadncts, alleys, driveways,
loading docka, eidewalks, stairways and pedestrian walkways) and
~ public ntilities (which term as nsed herein shall inclnde without
limitation, water, se«er, electricity, gas, telephone, pipeline, rail-
road, and other transportation and commnnication systems) and
~ similar easements and easements, licenses, restrictions and obliga-
s tions which do not in the opinion of the Company's connsel materi-
~ ally impair the use of sucli I.eased Parcel for the businesa pnrposes
~ of tlie Com~~:~ns or C'outinental ;
~ (d) mechanics', workmen's, repairmen's, snppliers', vendors'
~ or carriers' liens or other similar liens, provided that the sarae
~ shall be discharged by the Company in the ordinary course of busi-
~ ness ancl without undue delay or the amonnt or validity of the ~
~ same shall be contested in gooci faith with any pending ezecution ~
' ~ ~ thereof appropriately stayed;
