IISS AND OCCIIPANOY. ~ - The Company intenda dnring the Lease Term to use and occnpy ' , the Leased Premises for snch marketing, advertising, promotional, serv- , icing, managerial, adminietrative, research, mannfaotnring, proceasing, ~ assembling, storage, repair and related activities as it may determine from time to time. Neither the failnre so to use and ocx~npy the Leased Premisea nor any eviction of the Company from or loss of poasesaion by the Companp of any part of the Leased Premises by reason of title paramonnt or otherwise shall abate or rednce or change the basia rent or amounts in lien thereof payable by the Company to ~Properties nnder tLe provisione of this Lease or shall be a breach of tlus Lease in any respect. The Company agreea that in the use and occupancy of the Leased Premisea it will at all times comply with all such laws affecting ' the nse and occupancy of the Leased Premises and with such rnles and ~ regnlationa therennder, as ahall be binding npon it, and will comply witL ~ the proviaions of all former inatrnmenta of record affecting the Leased ~ Premises or any part tbereof at the time in force, which shall be binding : upon the Company, or by proper proceeding at its own espense have ~ any snch provision removed (or stay the enforcement of any sucL € provision) aa a eharge ngon the Leased Premises; provided, however, that the Company shall not be required to comply with any snch laws (either atatntory or common law), rules or regalations if it shall in good ~ - faith contest the validity, egistence or applicability thereof nnless as a ~ resnlt of its failnre so to complp the title of Properties to any significant ~ part of the Leased Premises wonld be inaterially endangered or the Leased Premisea or any part thereof wonld become subject to loss or forfeitnre (other than by virtne of the condition referred to in the last ~ sentence of Paragraph 3(b) in which event the Company shall comply ~ prior to the time when ita noncompliance wonld so result.
