Properties and the Trustee harmless from any costa and ezpensea }
reluted to any such contest and shall promptly pay any valid final ;
judgment enforcing any imposition and cause the same to be satiafied !
of record. The Company shall be entitled to recover from Propertiea ~
at the end of the Lease Term (other than pnrsuant to Paragraph 18(a) ) . ,
an apportionment as of snch end of the Lease Term of any impoeitions
assesaed against a Leased Parcel which shall remain the property of 3
. Properties after the end of the Lease Term and which have been paid t
by the. Company and relate to any part of a period of the taaing
; authority eztending beyond snch end of the Lease Term. Propertiea F
; snd the Trastee shall promptly forward to the Company any notice,
i bill or other advice received by it concerning any im}wsition and will use
' its best efforts and shall take anch lawfnl and reasonable steps as may
E be proposed by the Company in writing at the Company's coat and ;
~ eapense to minimize the impositions for which the Company is respon- -
~ sible nnder this Paragraph 9. The Company may pay any imposition in
~ installments if ao payable by law, whether or not interest accrnea on
the nnpaid balance.
~ lO. INSURAI~ CE.
~ The Gon~p~ny at its espense ~hall be entitled, but shall not be
~ wider an~~ obligation, to keep the bnildings, machinery, facilitiea, appnr-
~ tenances and other property forming part of the Leased Premisea in-
sured ugainsi such risks ancl liabilities, in such amounte and upon snch
~ ,
~ terrns as the Company may decm advisable, all payments in respect of
~ which shall be made to the Company. In addition, the Company may ~
~ self-insure in ~vhole or in part with respect to any riak or liability
~ _.iffecting or relating to the Leased Premises. Properties and the Trus- ,
~ tee each ~grees that, if and to the ~extent that the Company may reqnest,
~ it ~cill cooperate with the Company in connection with any action to be
~ taken under or in respect of such insurance and Propertiea hereby ap-
~ points and designates and reserves the rigbt in and for the Company, -
~ in its o«-n name or in the name of Properties, as the Company may elect,
~ to take all action ~vhich Properties may take in respect of snch insnrance .
