If any Leased Parcel shall be damaged or either partially or totally destroyed at any time dnring the Lease Term, there shall be no abate- ment or reduction in the rent payable by the Company to Prnpertiee, the Company shall continne to be obligsted under thia Lease in acxord- _ ance with the terms and provisions hereof, and the Company may, but shall be nnder no obligation to, repair and restore such Leased Parcel. If the Company shall elect not to restore any Leased Parcel which has been materially damaged or destroyed, it aLall give notice to that effect to the Trustee within 120 days after snch damage or destraction and promptly proceed to take such steps as may then be reqnired to comply with the applicable provisions of Paragraph 14(a). If, withont having ~ given snch notice, the Company shall not, within 180 days after snch ; damage or deatrnetion, have proceeded diligently to repair and restore ` sucL Leased Parcel, it shall be deemed to have so elected not to repair ' ~ E or restore. The Company shall give written notice to Propertiea and ' the Trastee of any material damage or destrnction with respect to a . ! ~ Leaaed Parcel (other than a ser~ice atation property or bnik plant) ~ within 60 days after the date of snch damage or destrnetion, specifying the natnre, eztent and date of occurrence thereof. If title to the whole or any part of ; ~ anp Leased Parcei, or the use thereof, sliall be taken or condemned by ' ~ a competent authority for any pnbtic nse or purpose, there shall for ~ ~ that reason be no abatement or reduction in the basic rent payable by f ~ ~he Company to Properties and the Company shall continne to be obli- ~ s gated under this Lease in accordance with the terms and provisions ~ ~ereof.
