Failnre by either Properties or the Company to insist npon the strict performance of any ~ of the covenants and agreements herein set forth or to ezercise any ~ rights or remedies upon default herennder shall not be considered or ~ taken as u~~•aiver or relinquisl~ment for the fnture of the rigLt to insist ~ npon and to enforce by any appropriate legal remedy a strict compliance ~ bs the defaulting part~ ~ith t~ll of the covenants and conditions hereof, ~ or of the right to egercise any snch rights or remedies, if anch defanit ~ be continued or repeated.
