PARTIAL RELEASB OF ASSIGNMENT AND INDENTURB
THIS IS A RLLEASB dated /j~,~y /B , 1979, between
BANKBRS TRUST COMPANY, a New York corpora ion with offices at 16 Wall Street
in New York, NeW York 10015, as Trustee under an Indenture of August 1, 1961,
with Stafac Inc., and SHEI.L OIL COliPANY, a Delaware corporation with offices
at Oae Shell Plaza (P. 0. Box 2463) in Houstoa, Texas 77001 (herein called
"Trustee" and "Shell", respectively).
TRUSTSE, for valuable consideration received~from Shell, hereby
releases and quitclaims to Shell all of Trustee's right, title and interest in
the premises situated at Orange Avenue and Angle Road in Fort Pierce, St.
Lucie Couaty, Florida, which were coaveyed by Shell to Stafac Inc., a Delaware
corporation ("Stafac") by the Warranty Deed dated December 16, 1963, and
recorded oa January 31, 1964, ia Book 80, page 117, in the Official Records of
th8t C011IIty ("Released Premises"~ : (1~ l~~dP~ thg AcAi onmP~t hq Stafac -to

Trustee dated December 18, 1963, and recorded on January 31, 19b4, in Book 80,
page 122, in that Office ("Assignment"), which relates to the Service Station
Lease between Stafac and Shell dated December 18, 1963, and recorded, by
Hemorandum of Lease, on January 31, 1964, in Book 80, page 119, ia that Office
("Lease"), wherein, as well as in the Assignment, the released Premises are
, described in Exhibit FLH08 thereto; and (2) under the unrecorded Indenture of
August 1961, between Stafac and Trustee ("Indenture").
Shell hereby acknowledges that neither (a) Stafac's conveyance of
the Released Premises to Shell by its Limited Warranty Deed dated Z ,
1979, nor (b) the consequent release of the Released Premises from the ease,
by merger in Shell of both the fee and the leasehold estates therein, nor (c)
this Release of the Assignment and the Indenture with respect to_the Released
Premises, does or shall release or affect in any way the Lease, the Assignment "
or the Iadeature with respect to any premises subject thereto, other than the
Released Premises.
