HomeMy WebLinkAbout1884 ~ ~ _ _ . . i . t I ~ . ~ , t RSCEIPT ACICNOWLEDGMENT ASSUMPTION AND ACCEPTANCB OF PURCHASER ' i ~ . ~ Purchaser, by acceptance and execution of this Receipt, acknowledges ~ that this purchase of a condominium unit at OCEAN VILLAGE OF NUTCHINSON ISLAND is subject in every respect to the Declaration of Condominium as eo the condominium ~ in which his unit is located and Exhibits attached thereto, including but not limited to (~rhether the same are attached to the Declaration of referred to ~ therein), the By-laws of the Association Articles of Incorporation, the Rules and Regulations, copy of pro3ected operating budget, copy of sales brochure and floor ~ plan of apartment purchased by Purchaser, and all Amendments to the aforesaid De- claration and Exhibits and the Articles of Incorporation, By-Laws and Declaration ~ of Covenants and Restrictions of the Property Owner's Association; and Purchaser further acknowledges_receipt of and reading and exam3nation of said Declaration, its ~ Exhibits, and budget, sales brochure and floor plan, and acknowledges that each and every provision_of the foregoing is essential to the suecessft~l operation and manage- ~ ment of the Condominium property and is in the best interests and for the benefit of ~ all the owners therein. Purchaser and all owners of parcels in the aforedescribed , Condominium covenant and agree to abide by each and every provision of said Declar- ation of Condominium and Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declaration of Condo- minium and Exhibits attached thereto, and agrees that the assessment under the Property Owner's Association documents referred to above and the provisions thereof ~ are reasonable, fair and equitable, and said Purchaser acknowledges and confirms that the Declaration of Covenants and Restrictions of the Property Owner's Association ~ has encumbered and impressed a lien upon the Condominium parcel being conveyed to ? Purchaser, as security for his obligations under the said Declaration of Covenants. and Restricitons of the Property Owners' Association and said Purchaser assumes the obligations as to the Property OWner's Association as to his condominium parcel. Purchaser confirms that all warranties, representations and inducements, if any, are as contained in the aforesaid Declaration of Condominium and Exhibits attached there- to, and the co~non expenses and the sums due under the Property Owner's Association ; and other charges are estimated only. No warranty or guaranty is made or intended ? nor may one be relied except where the same is specifically warranted or guaranteed in said Declaration of Condominium and the Exhibits attached thereto.
