. THIRD: If my said husband, BENJAMIN I. CHMIIRA. and I
should die simultaneously in a common accident or as a result
of a co~mmnon disaster or under such conditions that it will be
impossible to determine which of us died first, it shall be
presumed that I survived~my said husband, and this presump-
tion shall apply throughout this Will.
FOURTN: I hereby nominate and appoint my said husband,
BENJAMIN I. CHMiJRA; as Executor of this my Last Will and Testament
and hereby direct that no bond or other security be required

of him for the qualification, discharge and performance of his
duties as Executor of this my Last Will and Testament.~ If said
Executor named herein is unable, unwilling or ceases to so act,
then I appoint my said nephew, EDWARD MODZELESKI, to act in his
place and stead, also to serve without bond or other security.
_ FIFTH: I hereby grant to my hereinbefore named Executor

in addition to the general powers conferred upon him by law,
the following discretionary powers with respect to any and all
property or interests at any time constituting part of my estate:

(a) To continue, settle or discontinue any business or
partnership in which I may be interested.

~ (b) To continue to hold any property, real, personal or
` otherwise, including but not limited to stocks, bonds, real estate

~ or investments, in the form in which it shall be at the time of my
~ death without regard to the limitations imposed by law.

~ (c) To sell, lease, pledge, mortgage, transfer, exchange, _
~ convert or otherwise dispose of, or~grant options with respect
~ to any and all property at any time forming part of my estate,

` in such manner, at such time or times, for such purposes, for
~
~ such prices and upon such terms, credits and conditions as my
~ Executor may deem advisable.

(d) To exercise rights to subscribe to or convert securities.

~ stock in any and all corporations at any and all meetings of

~ stockholders for any and all purposes without any limitations
