THREE PARTY A6REEMENT
KNOWN ALL MEN BY THESE PRESENTS that-the undersigned Davis and Sons Concrete,
Inc., 3600 Oleander, Fort Pierce, Florida 33450, hereinafter known as "The
Sub-Contractor" have provided materials and/or labor on a pro~ect known as
concrete work located at Port St. Lucie, Florida~ resulting from a contract
dated February 13, 1979 between the above and General Development Corporation,
1111 South Bayshore Drive, Miami, Florida 33131. _
IN EXECUTION OF the contract, the sub-contractor shall submit for payment to
the Company every week, a written itemized bill for labor, equipment and
services furnished and materials installed during the preceding week, together
with a statement that all indebtedness incurred by the Contractor for labor,
equipment, materials and services included in such bill has been paid by ;
the Contractor, except those materials provided by Lone Star of Florida, ,
IT IS NEREBY the desire of the sub-contractor to use these monies as collateral
for a loan from the Port St. Lucie Bank, Port St. Lucie, Florida 33452,
hereinafter known as "The Bank."
IT IS HEREBY AGREED by sig~atures set to this document by all parties that the
earned monies when due and payable will be paid by check from the "Contractor" _
made payable to "The Bank" and "The Sub-Contractor" jointly, and that this s
agreement cannot be cancelled or altered without all parties rescinding this
agreement in writing.
