HomeMy WebLinkAbout1614 In accepting this conveyance and as part of the considera- tion therefor, Grantee for itself and its successors and i assigns, agrees that this conveyance is made upon and subject to ~ the following covenants, conditions, restrictions and reserva- tions which shall apply to and run with the land (herein called "Premises") being conveyed for a maximum of 40 years from the date hereof. ~A. No building or other structure shall be erected, placed or lo~ated upon the Premises unless a minimum parking ratio of at least 4.5 automobile parking spaces on the Premises is provided for each 1,000 square feet of the gross building area. B. Neither Grantors nor Grantee shall erect barriers imped- ing the free flow of vehicular. and pedestrian traffic between the Premises and Gr.antors' contiguous lands, both Grantors and Gr.antee, however, reserving the right to install traffic control devices that do not unreason- ably interfere with said traffic. C. Only one building including drive-in teller facilities shall be erected on the Premises. The building and drive-in teller facilities shall not exceed 15 feet in ' height. ~ ll. Neither the Premises nor any part thereof nor any build- 4 ing erected thereon shall be used at any time for the operation of : (i) any type of store commonly known as a"dollar store" or any store similar to Eagle Family discount stores. In the event Eagle Discount, or its assignee or successor operating the same type of business, is no longer. a tenant in the shopping center adjacent.to the ~i land convey~d known as St. L.ucie Plaza, this restric- ; tion shall automatically terminate and be of no further ~ force and effect; ~ E (ii) a drug or patent medicine store or drug pre- ~ scription-store or department; or a cosmetics, health ~ and beauty aids store or any operation requiring a reg- 4 istered pharrnacist. In the event Gray Drugs, or its ~ assignee or successor operating the same type of busi- ~ ness, is no longer a tenant in the shopping center ad- k jacent to the land conveyed known as St. Lucie Plaza, ~ ~ this restriction shall automatically terminate and be ~ of no fur.ther force and effect; ~ (iii) an ice cream shop, bakery and/or delicatessen or ~ any department or concession which would constitute the ~ equivalent thereof; a food super.market, grocery store, fancy grocery store or so- called "convenience" market, ~ a dair.y or frozen food store, a meat, fish, fruit or ~ vegatable market or any department or concession which ~ would constitute the equivalent of any of the foregoing. ~ In the event Winn-Dixie, or its assignee or successor ~ ~ operating the same type of business, is no longer a ~ r ~ . 3 ~ 2 ~ ~ _ ; L ~ ~~;'~K3i2 e,~Fi~i12 ~ ~ ~ - ~
