TRIS CAUSE having come on to be heard on the motion of the
Plaintiff for a Summary Judgment and the Court having reviewed the
pleadings and affidavits filed in this cause and being further advised
in the premises, it is hereby

i ORDERED AND ADJUDGED, as follows:

~ 1. Plaintiff, MAJOR EXCAVATING COMPANY, INC., is due Four
Thousand One Hundred and Ninety-One Dollars and Ninety-Six Cents
($4,191.96) as principal, One Thousand Five Hundred and Twenty-Two
Dollars and Twenty-Seven Cents ($1,522.27) as interest to date of this
judgment, Twenty-Five Dollars ($25.00) for title search expense, Four
Hundred and Twenty-Nine Dollars and Twenty Cents ($429.20) for taxes,

and Five Hundred and Fifty Dollars ($550.00) for attorney's fees with
One Hundred and Thirty-Six Dollars and Eighty Cents ($136.80) Court
costs now taxed, under the Articles Of Agreement sued in this action

making a total sum of_ $6,855.23.
2. Plaintiff holds a lien for the total sum superior to any
'claim or estate of Defendant(s), WAYNE H. KINGRY and EILEEN KINGRY, his ~

wife, and LESTER J. SUTER and LORETTA SUTER, his wife, on the following
