3. The Court finde and determines that 60~ of said fee
was a result of time spent by the attorneys for Business Securit
and Invest~igation Corporation, Inc., in defending the contract
action when the insurer, Parliament Insurance Company, had denie
+ it was under a duty to defend said contract action; said denial ~

f being contrarq to the well-established proposition of law that ~

i where the Compl$int against the insured contains allegations !
which are partially within and partiallq without the scope of ~

the insured's coverage, the insurer must defend even those i

~f portion of the complaint which are outside the coverage. ~
4. The Court finds and determines that 4070 of the time ~

~1 and the resultant fee assessed above was incurred in drafting, ~
~

presentation, and preparation of the Declaratory Judgment action,;

which Declaratory Judgment rendered on May 15, 1979, found that ;

the insured, Business Security and Investigation Corporation, j

Inc., was covered by the insurer's, Parliament Insurance Company,"
policq of insurance, and,that Parliament Insurance Company was ~

~ obligated to defend Business Security and Investigation Corpora-;
i
tion, Inc., on all counts of the Amended Complaint.
