The undersigned, as personal representative of the above
estate, alleges: _
1. The decedent, GOLDIE ROSS, a resident of St. Lucie
County, Florida, died on September 8, 1977, and Letters of Admin-
istration were issued to petitioner following CAROL M. TORRES,
the driver of the vehicle with which GOLDIE R06S collided, filing
a Petition for Administration as a potential creditor of GOLDIE
ROS S . ~

2. No assets have ever come into the hands of Petitioner

and, the only reason CAROL M. TORRES petitioned to have a personal
representative appointed for the Estate of GOLDIE ROSS was to be
able to obtain service of process on the personal representative
to obtain a recovery of damages against the inst~rance carrier of ~

! GOLDIE ROSS at the time of his accident causing injury to CARCL

r M. TORRES, Allstate Insurance Company. CAROL M. TORRES did file

Civil Action No. 77-482 CA against GOLDIE ROSS and ALISTATE IN-
SURANCE COMPANY and did serve process upon petitioner, a trial ~

was had and a verdict entered in behalf of CAROL M. TORRES. _

3. As previously stated by petitioner, there are no assets
upon which distribution can be made as GOLDIE ROSS left no probate f

ti assets at his death and, apparently, only owned a residence ~o y ~

with his wife, MITTIE ROSS, who did not file a petition for ad- `
~
ministration of th e Estate of GOLDIE ROSS, even though GOLDIE ROSS

died on Se tember 8, 1977, due to the fact that GOLDIE ROSS had no

assets at the time of his death. ~
