SECOND FLORIDA MORTGAGE AND SECURITY AGREEMENT ~ _ cJ ~ THIS MORTGAGE AND SECURITY AGREEMENT made this ~ day of July, 1979, CENTER WEST ASSOCIATES, a Florida general partnership, having an office in c/o Headway Florida, Inc., 8751 West Broward eoulevard, Suite 303, Plantation, Florida 33324, (hereinafter referred to as "Mortgagor"), and THE ROYAL BANR OF CANADA, a Canadian chartered bank having an agency at 68 William Street, New York, New York 10005 (hereinafter ' referred to as "Mortgagee"); W I T N E S S E T H: To secure the payment of an indebtedness in the principal sum of TWO HUNDRED THOUSAND DOLLARS ($200,000.00), lawful money of the United States of America, to be paid with interest (said indebtedness, interest a~d all other sums which may or shall become due hereunder being hereinaf ter collectively referred to as the "Debt") according to a certain note dated of even date herewith in the principal sum of TWO HUNDRED THOUSAND DOLLARS ($200,000.00) made by Mortgagor to the i order of Mortgagee (here_inafter referred to as the "Note"), the i final payment of which, if not sooner made, is due and payable ~ as provided in the Note which shall be a date no later than the f irst day of the month immediately succeeding the twenty- seventh anniversary of the first assignment of record of note ! and this Mortgage, Mortgagor has mortgaged, given, granted, s bargained, sold, aliened, enfeoffed, conveyed, confirmed and assigned, and by these presents does mortgage, give, grant, bargain, sell, alien, enfeoff, convey, confirm and assign unto Mortgagee all right, title and interest of Mortgagor in and to the property aescribed in Exhibit A-attached hereto and made a I part hereof (hereinatter referred to as the "Premises") and the ~ , ~ buildings and improvements now or hereafter located thereon ~ ; !
