afforded to Lender by reason of this Assignment are separate _
and cumulative remedies and it is agreed that no one of such
remedies whether exercised by Lender or not, shall be deemed to
be in exclusion of any of the other remedies available to
Lender and ehall not in any manner limit or prejudice any other .
legal or equitable remedies which Lender may have, includinq, ;
but not limitecl to, all rfghts and remedies of Lender under the
Note, the Mortgage or any other document or instrument ~ ~
evidencing, securing or guaranteeing payment of the Debt, in i
whole or in part. ~

12. It is the intention of the parties hereto that `
any and all other leases affecting the Premises or any portion
thereof presently in effect ot hereafter entered into by `
Borrower shall be covered by the provisions of this Assignment ~
and all such leases and all of the Borrower's ciqht, title and
interest in all such lPases, and the rents, additional rents,
charges, issues,_profits and other sums payable thereundec, are
heceby assiqned to Lender until the end of the respective terms
thereof and any renewals or extensions thereof, subject to all ~
of the terms, covenants and provisions of this Assignment. The
inclusion of any such lease under this Assignment and the
provisions hereof shall be evidence for all purposes of the
physical delivery of each such lease to Lender and Borrower
agrees to so deliver the same. Borrower shail, upon the
request of Lender, execute and deliver in recordable form all ~
instruments which Lender may teasonably request for further
evidence and confirm such assignment of each such lease, -
13. This Assignment shall be binding upon Borrower, £
and its successors and assigns and shall inure to the benefit
of Lender, and its successors and assigns.

f 14. This Assignment may only be modified, altered,
~ amended, or terr~inated by an agreement in writing_ executed by ~
f the parties hereto. ~

~ 15. Any notice, request, demand, statement or :
consent made hereunder or in connection hecewith shall be in ~
~ writing and shall be mailed by registered or certified mail, f
return receipt requested, and shall be tieemed giv~n when
~ postmarked and addressed as follows: .
