by counsel for the respective parties, and being otherwise fully
advised in the premises, it is thereupon,
ORDERED AND ADJUDGED, that -
1) The motion to dismiss the counterclaim filed by MADSEN
BUILDERS, INC. be and the same is hereby denied.

2) The plaintiff, counter-defendant, PHILIP CARUANA, shall have
ten (10) days from the date of this order to file his answer to the
counterclaim.
