ORDER GRANTING MOTIONS TO DISMISS
CROSSCLAIM OF HALSEY AIdD GRIFFITH INC.
This cause was heard on August 6, 1979 on the Motions _
of the Hon Company and Kroehler Manufacturing Company to Dismiss
the Crossclaim of Halsey and Griffith, Inc., and the Court having
heard argument of counsel and being advised in the premises, it
is
' ORDERED:
- 1. The Motion to Dismiss the Amended Crossclaim of
Kroehler Manufacturing Company served June 9, 1979 and the Motion
to Dismiss the Amended Crossclaim of the Hon Company served May 29,
1979 are granted and the Amended Crossclaim of Halsey, and Griffith,
Inc., served May 29, 1979 is dismissed for failure to sufficiently
allege facts to show 3urisdiction over Kroehler Manufacturing
Company and the Hon Company and for failure to allege that Halsey
and Griffith, Inc., was merely passively negligent and failure to
allege that the alleged defect in the chair was a latent defect.
2. Halsey and Griffith, Inc.-, is given leave to
serve a Second Amended Crossclaim after the Court determines the
