• (b) All right, title and interest of Mortgagor in and
to the land lying in the bed of any street, road or avenue, opened
or proposed, in front of or adjoining the Premises, and in and to
the appurtenances thereto.
(c) All rents, profits, issues, proceeds and revenue of f
the mortgaged properties fraa tine to time accruing, whether under
leases or tenancies now existing or hereafter created, reserving
unto Mortgagor, however, so long as Mortgagor is not in default
hereunder, the right to receive and retain the rents, profits,
issues, proceeds and revenue therefrom.
(d) All judgments, awards of damages and payments,
including interest thereon, and the right to receive the same,
which may be made with respect to the Premises as a result of the
exercise of the right- of eminent domain, the alteration of the -
g rade of any street, any other injury to or decrease in the value
of the Premises, or proceeds of insurance awards, to the extent of
all amounts which may be secured by this Mortgage at the date of
receipt of any such award or payment by Mortgagor, and of the
reasonable attorney's fees, coats and d ~sbursements incurred by
Mortgagee in connection with the collection of such judgment,
award or payment= and Mortgagor agrees to execute and deliver,
from time to time, such further instruments as may be requested by
Mortgagee to confirm such assignment to Mortgagee of any such
judgment, award or payment.- Mortgagee is hereby authorized on
behalf .and in the name of Mortgagor to execute and deliver valid
acquittances for, and to appeal from, any such judgments or
awards.- Mortgagee may apply all such sums or any part thereof so
received, after the payment of all its expenses, including costs
and attorney's fees, on the indebtedness secured hereby in such
manner as it elects, or at its option, the entire amount or any
part thereof so received may be released. -
(e) All machinery, apparatus, equipment, fittings,
fixtures and personal property of every kind and nature whatsoever
hereafter located in any buildings or improvements upon the
Premises, or any part thereof, and used or usable in connection
with any future occupancy of any buildings on the Premises, and
all crops and/or farm products now or hereafter located on,
pertaining to, arising out of or growing upon the properties
described in Exhibit 8 attached hereto, provided that until the
Mortgagor is in default hereunder as hereinafter .provided, it may sell,
j transfer or otherwise dispose of crops and/or farm products in the
ordinary course of its business, and the Mortgagor agrees to execute
and deliver, from time to time, such further instruments as may be
requested by Mortgagee to confirm the paramount and superior first -
lien of this P+~ortgage on the aforementioned property.
(.f) The Lessor's interest in all leases of the
Premises, or portions thereof, heretofore or hereafter entered
into by Mortgagor, and all right, title and. interest of Mortgagor
thereunder, including, without limitation, cash or securities
deposited thereunder to secure performance by the Lessees of their
obligations thereunder, regardless of how said cash or securities
are to be held by Mortgagor pursuant to the terms of such leases.
.'1b Have And Rb Hold the above-described properties unto
Mortgagee, its successors and assigns, forever, subject, however,
to the terms and conditions of this Mortgage.
Provided, however, that these presents are upon the
condition that:
1) if Mortgagor shall pay or cause to be paid to
Mortgagee the principal "and interest payments in respect
to the Promissory Note secured hereby, at the time and in
the manner stipulated therein and herein, all without any _
