BERKEY and JOHN L. HANNETT, Individually and as Cotrustees, by and through their undersigned counsel, hereby stipulate and agree as follows: I. On July-17, 1979, the Court in this action entered,a Final Judgment of Foreclosure in Favor of Plaintiffs and . against Defendants on the Promissory Note and Mortgage involved in this action, the originals of-said Note and Mortgage having been filed in the Court file. Since entry of said Final Judgment and prior to-the date set for judicial sale, Defendants have paid to~Plaintiff all sums due Plaintiff~as set forth in such Judgment, and Plaintiff acknowledges that Defendants have fully satisfied all sums due in the Final Judgment and under the - Promissory Note and Mortgage in this action, and Plaintiff claims no further interest in the real property described in such mortgage. Z. The parties agree that the judicial sale set for August 17, 1979 should be canceled by the Clerk inasmuch as Defendants have fully complied with payment~in full to Plaintiff prior to sale as required by Paragraph 8 of the Final Judgment 80~ X14 ~~~~2284 - Fe= ~ ri ~1 -
