(2) Mortgage in the amount of $600.00 given by Patricia Ruth
Hughes to W. H. Crusius, Jr. and Adonza F. Crusius, his wife,
dated October 18, 1962, filed October 26, 1962, in 0. R. Book
48, page 628, encumbering Parcel 2, of the public records of St.
Lucie County, Florida.
In the event either of the abovesaid mortgages should ever prove
to be a valid debt against the subject property, the Mortgagor
' herein is authorized to set off and pay same from any of the
proceeds due hereunder on the promissory note secured by this
mortgage. The Mortgaged further assures the Mortgagor that the
statute of limitations shall cure any claim for outstanding lien
after the maturity date of said lien has passed its 20th year.
Mortgagee further acknowledges that there exist two mortgages to
Sun Bank of St. Lucie County as~follows:
(1) Mortgage in the original- principal amount of $10,493.28,
as recorded in 0. R. Book 245, page 1409, public .records of St.
Lucie County, Florida;
(2)~ Mortgage in the original principal amount of $8,520.00, as
recorded in 0. R. Book 273, page 324, public records of St. Lucie
County, Florida;
wherein said mortgages encumber the subject property (hereinafter
referred to as Svn Bank mortgages). Mortgagee warrants that the
Sun Bank mortgages are in good standing. Mortgagee agrees that
it shall continue to be the responsibility of Mortgagee to. promptly
pay and discharge all obligations under the Sun Bank mortgages
as they become due. Mortgagee further agrees to indemnify and hold
- Mortgagor harmless of and from any claim, loss or demand on account
of the existence of the Sun Bank mortgages, and further agrees
that if the Mortgagee fails to promptly pay any sums due under the
Sun Bank mortgages, then Mort a or, at its o tion, ma a the

same and deduct the amount of such payment, together with, interest
thereon, from the next payment coming due under the promissory note
secured by the purchase money mortgage herein. Upon request by the
Mortgagor, Mortgagee shall from time to time furnish Mortgagor with
~ copies of cancelled checks or other satisfactory evidence reflecting
that the Sun Bank mortgages are. current and in good standing.
Mortgagee further warrants that the Sun Bank mortgages shall be
paid in full and appropriate satisfactions thereof recorded in the
public records of St. Lucie County, Florida, simultaneously with or
prior to payment in full of the promissory note secured by the
purchase money mortgage described herein.
