Court having heard argument of counsel and having considered the pleadings,
affidavits and Request for Admissions file:l herein, it is hereby
ORDERED AND ADJUDGED as follows:

Plaintiff's claim against Defendant.
2. Plaintiff's Motion for Summary Judgment against the
