Plaintiff's Motion for Summary Judgment and it is
ORDERED and ADJUDGED as follows:
(1) That the following material facts appear without substantial
controversy and shall be taken as true in subsequent proceedings:
(a) That on Juae 21, 1971, Defendant Al Johnson, who was
then President of the Plaintiff corporation, executed and delivered
the promissory note dated Juae 21,_1971, to the Plaintiff corporation;
(b) That the Defendant Al Johnson made the following

payments to the Plaintiff on the note:
February 28, 1974 - $4,700.00
December 31, 1974 - $2,000.00
January 31, 19.75 - $1,500.00 .
(c) that the payee named in the promissory note dated
June 21, 1971, as Al Johnson Motors is the Plaintiff Johnson Chrysler Plymouth,
Inc., f/k/a Al Johnson-Motors, Inc.;
