4. The said Defendant shall have the right to file an
Affidavit on its behalf at the time of the hearing shown in
Paragraph 1. above.. Further, should this Court find that
the Plaintiff is entitled to the possession of the claimed
property pending the final adjudication of the claims of the
parties hereto, the Defendant shall have the right to file
with the Court a written undertaking executed by a Surety
approved by the Court in an amount equal to the value of the
property to stay any order issued by this Court authorizing
the delivery of the property to the Plaintiff.
SHOULD TAB DEFENDANTS FAIL TO APPEAR AT THE HEARING OR
TO FILE AN AFFIDAVIT AS PROVIDED ABOVE, SAID DEFENDANTS
SHALL BE DEEMED TO HAVE WAIVED ITS RIGHT TO A HEARING. AND
IN SUCH EVENT, THIS COURT MAY ORDER THE CLERK OF THE COURT
TO ISSUE A WRIT OF REPLEVIN AS TO THE CLAIMED PROPERTY. _
