MODIFICATION AGREBMBNT r
THIS AGREEMENT made this r~~ day of June, 1979, _
by and between GAYLB GILMAN ARTZ, hereinafter called "Mother,"
•and ALAN ARTZ, hereinafter called "Father."
WITNESSETH: ,
The parties-are no longer Husband and Wife having been
divorced on August 27, 1975. The parties entered into an Agree-
ment dated July 28, 1975 which, among other things, provided for - •
support, custody, and visitation with regard to the child of the _
parties, DARBY RICHARD ARTZ.
That Property Settlement Agreement herenabove referred
to was incorporated in and made a part of the Final Judgment
dated August 27, 1975. Subsequent to that time, the Father peti-
tioned the Court for a modification of said Judgment and the Wife
filed her Answer. Likewise, the Mother is contemplating_ a modi- =
fication of said Order; however, both parties have resolved their
differences with respect to the issues framed in such pleadings.
~ Therefore, the parties agree:-
CUSTODY OF CHILD
1. The Mother shall have the care, custody and control
of the child; however, paragraph 3 of the Agreement dated July 28,
1975, is modified as follows:
(A) Father shall have a right to visit with the
child, at the Father's residence, for four (4) weeks each and
every summer, and for one (1) week during the winter, or spring, -
either during the Christmas or Easter vacation periods. Said
visits are not to conflict with the child's school .term. Prev-
ious arrangements are to be made by and between the Father and the
Mother. Each party•shall notify the other promptly of any serious
illness or any serious accident befalling the child during the
time either of the parents have custody of the child and, with j -
