STIPULATION OF PARTIAL SETTLEMENT
CASE N0. 78-212-A
COMES NOW the Defendant/Third Party Plaintiff, UNITED
STATES FIDELITY & GUARANTY COMPANY, by and through its undersigned
attorneys and the Third Party Defendants, WAYNE B. MARTIN, C. R.
LOMBARDO, GEORGE F. DAVIGLUS, NORMAN HILLARD AZEN and RICHARD F.
POWER, by and through their undersigned attorneys and in partial
settlement of the claims between them, as framed by the Third Party
Complaint, Answer and Affirmative Defenses thereto, hereby Stipulate
and agree as follows:
1. In the event that any of the Plaintiffs, to wit,
GEORGE H. CULVERHOUSE, JR., JOHN BRADFORD CULVERHOUSE and/or SYBIL
LEVITA CULVBRHOUSE, owe or become authorized to recover by judgment,
order or decree any sum from the Defendant, UNITED STATES FIDELITY
~ GUA,RANTY COMPANY, in connection with the matters set forth in the
Plaintiff's Amended Complaint, then the Third Party Defendants,
WAYNE B._MARTIN, C. R.-LOMBARDO,-GEORGE F-. DAVIGLUS, NORMAN HILLARD -
AZEN and RICHARD F. .POWER, shall be jointly and severally liable to
pay the full amount of any such judgment, order or decree on behalf
of UNITED STATES~FIDELITY & GUARANTY COMPANY.
2. The issues as to costs and attorney's fees as between

~ these parties shall be heard by the Court in a separate proceeding
and need not be heard at the trial of this principle cause.
