I, ORANGE F. YORK, of St. Lucie County, Florida, do
hereby make, publish and declare this to be my Last Will and
Testament, and hereby revoke any and all other Wills and Codicils
heretofore made by me.
CLAUSE I: I direct my personal representative to pay,
out of my residuary estate, all of my just debts including the
expenses of my last illness and funeral expenses.
CLAUSE II: I give and devise all of the rest, residue
and remainder of my property, real and personal, wherever situate
and whether acquired before or after the execution of this Will,
to my wife, EDNA MAY YORK, as her awn absolutely, provided she
survives me, and if my said wife does not survive me, then all of
said property shall go instead as follows:
A. I give and devise FIVE HUNDRED DOLLARS
($500.00) to my granddaughter, ROGENIA YORK (daughter
of my- deceased-son, -Roger__York)- . -
B. The .balance of my residuary estate, I
give and devise to my son, EDGAR P. YORK provided
that if he does not survive me, then all of said
property shall go instead equally to my said son's
children, E. MALCOLM YORK and MELANIE ANNE METZLER,
per stirpes.
CLAUSE III: I nominate and appoint my son, EDGAR P.
YORK as personal representative of this Will, to serve without
bond.
My personal representative is invested with full power and
authority to sell, convey, transfer and assign any and all personal
property and real estate belonging to my estate.
CLAUSE IV: In the event that my wife, EDNA MAY YORK,
and I die under such circumstances that it cannot be determined
which of us predeceased the other, I direct that it shall be
conclusively presumed that I survived my said wife, and the
provisions of this Will, shall be construed and the distribution of
