ARTICLE III - ELIGIBILITY HGUR 230 ~aG: 071
3.1 CONDITIONS OF ELIGIBILITY. Any Employee who has completed
one (1) year of Service and as reached his`twenty-fifth (25th)
irthday shall be eligible to participate hereunder .as of the
first day after he has satisfied such requirements. The Employer
.shall give each prospective Eligible Employee written notice of
his eligibility to participate in the Plan in sufficient time
to enable such prospective Eligible Employee to submit an application
for participation in the Plan prior .to the close of the Plan Year
in which he first becomes an Eligible Employee.
Except, however, any Employee whose date of employment is within
S years of his Normal Retirement Date shall be excluded from parti-
cipation in the Plan.
3.2 APPLICATION FOR PARTICIPATION. In order to become a
Participant hereunder, each Eligible Employee must make application
to the Employer for participation in the Plan and agree to the
terms hereof. Such application shall be effective as of the first
day of the Plan Year preceding its submission. In the event any
Employee otherwise qualified to become a Participant fails to
file such application, the Employer may thereafter file such application
on behalf of such Employee on a nondiscriminatory basis. Upon
the acceptance of any benefits under this Plan, such Employee
shall automatically be bound by the terms and conditions of this
Agreement and all amendments hereto.
3.3 DETERMINATION OF ELIGIBILITY. The Administrator shall_
determine the eligibility of each Employee for participation in
the Plan based upon information furnished by the Employer. Such
determination shall be conclusive and binding upon all persons.
3.4 TERMINATION OF ELIGIBILITY. A Participant shall cease
to be eligible to participate in the Plan and his participation
in the Plan shall terminate in the event his employment by the
Employer is terminated. For all purposes of this Plan, a Participant's
employment shall be deemed to have been terminated as of the first
day of a Plan Year during which he has a 1-Year Break in Service
and he shall be deemed to have been reemployed as of the first
day of his first Year of Service following his 1-Year Break in
Service.
