or enacted. The Mortgagor, for itself and all who may claim under it, waives, to the
extent that it lawfully may, all right to have the. Mortgaged Property marshaled upon
any foreclosure hereof.
SBCTION 14.04. No failure by Mortgagee to insist upon the strict performance
of any covenant, agreement, provision, term or condition of this Mortgage or to exercise
any right or remedy consequent upon a breach thereof, shall constitute a waiver of anp?
such breach or of such covenant, agreement, provision, term or condition. No covenant,
agreement, provision, term or condition of this Mortgage to be performed or complied
with by Mortgagor, and no breach thereof, shall be waived, altered or modified e~xept
by a written instrument executed by Mortgagee. No waiver of any breach shall affect
or alter this Mortgage, but each ~rtd every covenant, agreement, provision, term and
condition of this Mortgage shall continue in full force and effect with respect to any
other then existing or subsequent breach thereof.
SECTION 14.05. Each right and remedy of Mortgagee provided for in this
Mortgage shall be in addition to every other fight or remedy provided for in this Mortgage
or now or hereafter existing at law, or in equity or by statute or otherwise, and the ex-
ercise or beginning of the exercise by Mortgagee of any one or more of the. rights or
remedies provided for in this Mortgage or now or hereafter existing at law, or in equity
or by statute or otherwise shall not preclude the simultaneous-oHster-ex
gagee of anp? or all other rights or remedies provided for in this Mortgage or now or here-
after existing at law, in equity or by statute or otherwise.
SECTION 14.06. In the event of any breach or threatened breach by Mort-
gagor of any of the covenants, agreements, terms or conditions contained in this Mort-
gage, Mortgagee shall be entitled to enjoin such breach or threatened breach and shall
have the right to invoke any right and remedy allowed at law or in equity or by statute
or otherwise as though other remedies were not provided for in this Mortgage.
SECTION 14.07. The term "unavoidable delays" as used in this Mortgage
shall mean delays due to strike lookout or other labor or industrial disturbance (whether
or not on the part of employees of Mortgagor), civil disturbance, future valid order of
any government, court or regulatory body having proper jurisdiction, act of the public
enemy, war, riot, saboffige, blockade, embargo, failure or inability to secure materiels
or labor by reason or priority or similar regulations or orders or any government or re-
~ gulatory body, lightning, earthquake, fire, storm, hurricane, flood, washout, explosion,
act of God or any cause whatsoever beyond the reasonable control of Mortgagor whether
or not similar to the causes hereinbefore enumerated.
SECTION 14.08. Tn the event that Mortgagor or any partner of Mortgagor
is an occupant of part of the Mortgaged Property, Mortgagor and any such partner of
Mortgagor hereby agrees to surrender the possession of said part to Mortgagee immediately
upon any default hereunder and if Mortgagor or any such partner of Mortgagor remains
in possession, such possession shall be as tenant of Mortgagee, and Mortgagor and any
such partner agrees to pay monthly in advance to Mortgagee such rent for the premises
so occupied as the Mortgagee may reasonably demand, and in default of so doing, MoM-
gagor and any such partner may also be dispossessed by summary proceedings or otherwise.
Tn case of the appointment of a receiver of rents and profits of the Mortgaged Property,
the covenants of this paragraph may be enforced by such receiver.
SEC'T'ION 14.09. No recovery of any juk~ment by the Mortgagee and no
levy of an execution under any judgment upon the Mortgaged Property or upon any other
property of the Mortgagor shall affect in any matter or to any extent, the lien of this
Mo~ctgage upon the Mortgaged Property or any pert thereof, or any liens, rights, powers
or remedies of the Mortgagee hereunder, but such liens, rights, powers and remedies
of the Mortgagee shall continue unimpaired as before.
SECTION 14.10. In the event that Mo ~

close this Mortgage, Mortgagor authorizes Mortgagee at its option to fo~ceclose this Mort- i
gage subject to the rights of any tenants of the Mortgaged Property, and the failure
