O R D E R
THIS CAUSE having come on before the undersigned on
August 28, 1979, upon the Defendant's Motion to Strike and
Motion to Dismiss, having heard argument by the Defendant and
being otherwise advised in the premises, it is accordingly,
ORDERED and ADJUDGED that the 24otion to Dismiss and
Motion to Strike are granted and the Plaintiff shall file an
Amended Complaint setting forth, in three counts, a separate
claim each for negligence, statutory liability, and punitive
damages. At the time said Amended Complaint is filed the
Defendant may then assert any or all defenses to said Amended
Coartplaint which were initially raised in its Answer to the

Complaint.
At or before the time an Amended Complaint is served
herein the Plaintiff shall file a Memorandum of Law showing
why he should have a cause of action in negligence and should
be allowed to recover for punitive damages and the Defendant
shall have fifteen days within which to file a Memorandum of
response.
DONE and ORDERED in Chambers at Fort Pierce, St. Lucie
