PROPERTY SETTI£NENT AGREEi~NT
THIS AGREII~IEN1', made anered into this 15th day of
September , 1976, and between GARRY 0. BIGGERS, JR.,-
hereinafter referred to as "HUSBAND", aad DAVNA. F. BIGGExS, hereinafter
referred to as "tdIFE";
W I T N E S S E T H:
WHEREAS, the Husband and Wife Were lawfully married to each -
- other on August 19, 196b, in Charlotte, North Carolina, and thereafter
cohabited together as husband and wife, until October of 1974; and
WHEREAS, unhappy matrimonial differences have arisen beL-raeen
them by xeason of which they are not living together as husband and
wife; and
WHEREAS, both parties have given much thought aad careful coa-
sideration to a settlement of their matrimonial differences and have
detenained that they are irreconcilable, and the marriage is irretrievably
broken; and -
WHEP.EAS, it is the desire and intention of the parties hereto
that tfieir relations," -with-~cespect to property and financial matters,
be finally fixed by this Agreement in order to settle and determine _
in all respects and for all purposes their respective present and future
property rights, claims and demands; and
WHEREAS, there is one minor child of the marriage, SHERRY LYNNE
BIGGERS, age seven (7) years;
NOtd, THEREFORE, in consideration of the premises, the mutual
promises and undertakings herein contained, and for other good and valuable
considerations, receipt of which is hereby acknowledged, the parties agree
as follows:
1. That the foregoing recitals are true.
2. That the parties hereto may and shall at all times hereafter
live separate and apart, and shall be free from interferences, authority
and control, direct or indirect, by ti-.e other, as fully as if he or she
were sole and unmarried.-
3. That both parties agree and acknowledge that the Husband shall
pay no aliczony to the t:ife, tecaporary or permanent; and the Wife hereby waive
any right to alimony for all time.
