4. The Wife hereby relinquishes alI right, title and interest she
may have to the household furniture, furnishings and appliances located in
the marital residence, and hereby conveys her right, title aad interest is
said goods to the Husband to be his absolutely and forever.
S. The Wife shall have the right to remove her personal cloChing
and other personal effects now in the possession and control of the Husband.
6, The Wife agrees, upon the execution of this Agreement, to coa-
vey to the Husband by Quit-Claim Deed all of her right, title and interest in
and to the real property described as followsc
Approximately one (1) acre, two (2) partially completed houses,
chicken house, wood house and improvements thereon on Lot 4,
Sheet 30, Broad River Township, Buncombe County, North Carolina,
aad further described in Deed Book 1036, Page 309, in the Office _
of the Register of Deeds far Buncombe County, North Carolina.
7. In return for said Quit-Claim conveyance, the Husband agrees
to pay to the Wife a lump sum of THREE THOUSAND AND NO/100 Dollars ($3,000.00
in the form of a cashiers check or money order made payable to "McCain ~
Browd, Trust Account", said check or money order to be held in said trust
account until the said Quit--Claim Deed has been properly executed, acknowledg
and forwarded for recordation by the Wife. -
8. Both Husband and Wife agree that primary custody of the minor
child of the parties, SHERRY LYNNE BIGGERS, shall be s~rith the Wife subject
to the following:
a) The Husband shall have reasonable rights of visitation
to and with the child. The term "reasonable rights~of nisi-
. tation" shall be construed liberally;
b) During school vacation periods in the summer, the
Husband shall have the right to have the aainor child live
with him`for a period of thirty (30) consecutive days pro-
viding arrangements are c?ade with the Wife is advance,
including payment by the Husband to the Wife of any travel
expense occasioned by such visitation; -
c) the Husband shall also have the right to have the
minor child live with him for one week during the remainder
of each year (exclusive of sub-paragraph (b) above), upon
giving the Wife one month's notice of the visitation period
selected by-the Husband. The Wife has the right to refuse
this selection for good cause shown, but the Wife must give
the Husband an alternative tfine when he may exercise his
right of one (I) week visitation upon her refusal of Rusband's
selection. _
d) The Husband shall also have the right to communicate
with the minor child by snail and by telephone at reasonable
hours of the day.
e) Each party shall notify the other promptly of any
serious illness or of any serious accident befalling the
said minor child.
f) Concerning all cutters of policy involving. the child,
such as her health and education, the parties shall confer
with a view to adopting a harmonious attitude best calculated
to promote the child's welfare. -
g) The parties shalt use all reasonable efforts to naintain
free access aad to create a feeling of affection between theQ-
selves and the child. Neither shall. do anything to hamper
the natura~ development of the child's love and respect for
the other party.
