NOW CO,IEt S William S. Eubanks, Attorney for the Plaintiff, Garry
0. Biggers, Jr., pursuant to Rule 59 of the Rules of Civil Procedure, and
respectfully shows the_Court:
1. That this action was tried without a jury and upon Findings
of Facts and Conclusions of I.aw, Judgment was rendered on the 15th day of
November, 1976, granting the Plaintiff an absolute divorce from the Defendant
That under Paragraph~No. 5 of that same Judgment, the Plaintiff fs ordered
to pay TWENTY AND NO/100 DOLLARS ($20.00) per week as child support, payable
monthly to the Clerk of Court in Buncombe County, North Carolina, to be seat
to -the Clerk of Court - of St. Lucie County, Florida, to be forwarded to the
- _ _ _ _
Defendant at her address in St..-.Lucie County, Florida.
2. That both the Plaintiff and the Defendant, by and through
their attorneys respectively, William S. Eubanks for the Plaintiff, and
John E. Sherrard for the Defendant, have agreed that Paragraph No. 5 of
the Judgment should be amended to read as follows:
That the Plaintiff pay TWENTY AND NO/100 DOLLARS ($20.00)
per week as child support, payable monthly to the Clerk of
Court in Buncombe County, North Carolina, to be forwarded
to the Defendant at her address in St. Lucie County, Florida.
Eoth the Plaintiff and the Defendant have agreed that this amendment is
needed and would be in the best interest of both parties and their minor
child.
IT IS THEREFORE ORDERED that the Judgment of November 15, 1976,
4Cry15Q be amended to read as follows: _
That the Plaintiff pay TWENTY AVD NO/100 DOLLARS ($20.00)
